I have a 2005 expy when i bought it it came with a 3 year 36k mi warranty, so i have about a year left on it.. I decided to take it to the dealer and try and get the cam phazers fixed,(sounded like a diesel), the dealer said they were bad and needed replaced, they would contact the warranty company they wanted oil pressure test done to make sure there were no oil issues. after the test were done, they agreed to cover the cam phazers, so i got new cam phazers new timing chains tennisioner ect. the cost was 2k,, only cost me a 100 out of pocket.. and all of that took 3 weeks, not the dealers fault it was the warranty company that took so long to approve it all,, now my problem!!! I got a letter from the warranty company saying because i put aftermarket wheels and tires and a CAI on my car that they are no longer going to cover my warranty claims anymore,, this sounds like B.S!! to me,, anyone have any suggestions on what i can do?? any legal advice?? any input would be great,,anybody run into this before? thanks

Ask if they can prove that any of the aftermarket stuff caused the problem, now,and in the future.
have them put it in writing and address it to your lawyer

I need to know more info on this.

1. Your post is confusing. Are they paying for what they say there were going to or not?

2. Someone told the warranty company about your rims and intake bc they are not part of the dealer unless they came in to personally approve your vehicle and if they did then why did they approve this repair and not future ones.

3. In the price of your expy was this warranty added in or not?

My wife is HR director for ford so she deals with this shit.

I could see the argument with the rims but Ive seen too many of these things happen when an aftermarket intake is added...they figure when you add performance items that you abuse the vehicle more than if it were stock....but with adding wheels....thats some horseshit....

Yes. They did pay for the work! I had to pay the 100 deductible, The price of the warranty was added in to the price of the car payment, and the way they found out about the wheels and CAI, because the warranty company sent a inspector to the dealer to make sure the claim was valid, thanks for the input on this.

There is a law out there (don't recall the name of it) that essentially says that a warrantee can not be voided just because there have been alterations done to a vehicle. With that being said, if they can prove that the modification lead to the failure, then the owner of the vehicle is on the hook. So, in the case of the CAI, if the tranny was to go out, there is no relationship there, the warrantee company is still on the hook. But, if say you over oiled the CAI and it dripped down the intake and took out the MAP sensor, then you are on the hook for that.

Ask the company to put the denial of warrantee down on paper along with a reason for the denial. If they can only come up with aftermarket items added to the vehicle (and make the spell them out), then you can write them a nice letter back stating that you have seeked legal advice and are looking to file a claim as the justification that they are using is illegal and you are invoking your rights. I'm sure that will get their attention.

If everything doesnt work then you should get a refund check for the warranty

yes they can,,they are telling u in the future that if u bring ur car in for warrenty work that it will not be covered cause its NOT IN ORIGINAL EQUIPMENT from when bought,,my buddy had same problem with his vette,he blew the trans and took it to the dealer and they said it had aftermarket wheels on so no warenty, car only had 10.000 miles on it,he went to court and proved that the wheels didnt cause the breakage and ins claim ppl came back and said ITS NOT ORIGINAL EQUIPMENT from when purchased so case closed he was ass out 2.500 bucks,,so in ur case they are telling u ahead of time

That law is called the Magnusson-Moss act. They cannot deny warranty coverage unless they prove that the aftermarket part installed actually caused the problem.

Otherwise every new car warranty would be voided the first time someone used a non-oem oil or air filter.

They will be hard pressed to explain how your wheels caused a engine problem.

hence why i dont get warranties they will use any excuse not to pay. destroy them on the internet while your at it give them lots of bad reviews have others do the same. look up different sites that give reviews and make sure you say something about them. reviews are everything this day. if you want put down date and city state when happened that way they know who the pissed off. when i get screwed i devote alot of time to get payback. if you can hurt their pocket do it
