Fuel Pump on 2008 EL

My 2008 EL died on the highway on July 23rd, it has about 65K miles on it. Dealer says it needs a fuel pump, but the part is on backorder. It has been over 5 weeks, and still no definite word on when the part will be available. No help on a rental car from Ford Customer Service. The dealer service manager says they won't install a used part because it will probably fail in less than a year, and they haven't been able to source the part from any other vendors. The part is unique to the EL, and the dealer also won't install the pump for a regular (non EL) Expedition for some reason.

I am up a creek. Isn't there some policy that spare parts should be available for some period of time? Any advice?

Unfortunately not in this circumstance that I know of. Parts generally have to be available for ten years after a model is discontinued. I do not know of a readily available definition maybe check with your State Consumer Protection Office or the branch of State government that handles the Lemon Law Act for your State they should know all of the laws regarding this. Is there an extended warranty from it being CPO certified pre-owned or otherwise? I am going to assume the answer is no. Go to your warranty manual, the little manual that came with the car that deals only with the warranty and see the procedure for escalating a problem. The same info may be in the owners manual as well. Call Ford in Dearborn and see if they can resolve this problem if this is different from the customer service you referred to. I did not know there was a different fuel pump for the EL. When you say "used" are you meaning remanufactured part from Ford too?
That is a long time to wait and I have been there for four weeks as well so I can share your frustration. At this point I would get on the phone and make everyone at Ford know how I feel. At the same time I would be proactive on the internet calling every Ford and Lincoln dealer in North America, Mexico and everywhere else asking for that part number. Someone has to have it.
At this point I would tell the dealer to install the used part and you would assume liability if it failed in a year.

That was the main problem with my old 2007, the fuel pump. I went through 3 of them in a short time span. Then the fuses started to go so I ended up selling it.
