Any codes? The CEL won't light up for transmission issues, unless its a big issue.

Speedometer maxing out probably means its getting a short circuit somewhere/bad connection.
I would check the wiring for the main TCM connector that's on the back of the transmission.

Did the TCM get programmed to the car after the tranny swap was done?

Do you have an OBDII scanner or ForScan to read the transmission codes from the PCM and to watch what the transmission is doing? Just a cheap code reader is not gonna do it for this.

On my 2004 the TCM is the transfer case module.

You probably won't find anything in the wiring. The speed sensor is different between these two transmissions. You need someone that programs the PCM for the newer speed sensor. That also explains weird shifting situation. Next question is after all this is; Will be the shift timing be correct?

the transmission you are talking about is a 4r75w/e i didnt swap it with one of those i know those transmissions have a different ring gear but i doubt ford changed the 4r70w ring gear just for one year

Several of us compared the transmission ID tag recently and identified that our 2004 models had the 4R75 which certainly surprised me. My tag is 4L1P-DA. Anyway this list of model numbers might help if there's any question on the trans identification.
